This matter is before the court on remand from the United States Supreme Court. While a petition for writ of certiorari was pending, the Supreme Court decided Lingle v. Norge Division of Magic Chef, Inc., 486 U.S. 399, 100 L. Ed. 2d 410, 108 S. Ct. 1877 (1988). After rendering the Lingle decision, the Court vacated the judgment, and remanded the instant case "for further consideration in light of Lingle . . . ." The Court expressed no opinion as to the effect that Lingle would have on this case. Dougherty v. Parsec, Inc., 486 U.S. 1049, 100 L. Ed. 2d 914, 108 S. Ct. 2812 (1988).
